3.1 Age Requirement

For Paid Subscription Users: You retain full ownership and rights to the content you create using our Service ("User Content"). Subject to these Terms, Dova AI grants you a royalty-free, perpetual, irrevocable, worldwide, non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, derive revenue from, and publicly display your generated content.
For Free Tier Users: You retain ownership of your User Content but are granted limited usage rights as specified in Section 4.4.
4.2 License to Dova AI
By using our Service, you grant Dova AI:
- A worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing and improving our Service
- The right to use your User Content for training and improving our AI models
- The right to use anonymized and aggregated data derived from your usage for research and development purposes
Note: This license does not apply to enterprise customers, who are subject to separate enterprise agreement terms.
4.4 Commercial Use Rights
- Paid subscription users have full commercial rights to their generated content and may use it for any lawful commercial purpose
- Free tier users may use generated content for personal, non-commercial purposes only
- Content created with free tier may include watermarks that cannot be removed
- Model Release Requirements: For content depicting identifiable people, you must ensure you have appropriate model releases for your intended use, particularly for commercial purposes
4.7 Platform Attribution
We reserve the right to request attribution when you publicly share or distribute content created with our Service, particularly for promotional purposes.
5. Prohibited Content and Conduct
You agree not to use the Service to create, upload, or share content that:

- Contains explicit sexual material, nudity, or other NSFW (Not Safe For Work) content
- Contains misleading, false, or inaccurate information
- Engages in unauthorized face-swapping or deepfake creation
- Could endanger or exploit children by exposing them to inappropriate content
- Shares personal details of others without their explicit consent
- Discloses information you are not authorized to share due to legal, contractual, or fiduciary obligations
- Includes any unsolicited promotions, political campaigning, or commercial solicitations
- Infringes on the intellectual property rights of others (including film, television, animation, game characters, trademarks, and more)
- Promotes violence, hatred, or discrimination against individuals or groups
- Contains harmful, threatening, abusive, or harassing material
- Is deceptive, misleading, or intended to spread misinformation
- Violates any applicable laws or regulations
- Infringes on the intellectual property rights of others
- Contains malware, viruses, or other harmful code
- Depicts illegal activities or promotes illegal conduct
5.2 Prohibited Conduct
- Attempting to reverse engineer, decompile, disassemble, or hack our Service
- Using the Service for commercial purposes while on a free plan (unless explicitly permitted)
- Creating multiple accounts to circumvent usage limits
- Sharing account credentials with others
- Using automated tools, bots, spiders, or scrapers to access the Service
- Interfering with or disrupting the Service or servers and networks connected to the Service
- Attempting to gain unauthorized access to any portion of the Service
6. Subscription Plans and Payment

We offer a free tier with limited features and usage quotas. Free tier access may be modified or discontinued at any time. Free tier generated content may include watermarks.
6.2 Paid Subscriptions
Paid subscription plans provide access to premium features and higher usage limits. By subscribing to a paid plan, you agree to:

- Automatic renewal of your subscription unless cancelled
- Our use of payment processors (such as Apple, Stripe) to process payments
6.3 Credit System
- Our services operate on a credit-based system where different features consume different amounts of credits
- Credits are allocated monthly based on your subscription plan
- Unused credits do not roll over to the next billing period
- Additional credits can be purchased as needed

- You are responsible for reviewing and validating AI-generated content before use
- We do not guarantee the quality, accuracy, appropriateness, or uniqueness of AI-generated content
- AI-generated content may contain errors or inaccuracies due to the probabilistic nature of machine learning
10.3 Warranty Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED OR ERROR-FREE OPERATION, AND FREEDOM FROM HARMFUL COMPONENTS.
10.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our total liability for any damages arising from these Terms or your use of the Service will be limited to $50 USD or the amount you paid us in the 12 months preceding the claim, whichever is greater
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business interruption, or loss of business opportunity
- We are not responsible for any loss or damage caused by viruses, distributed denial-of-service attacks, or other technologically harmful material

12. Termination

Upon termination:

17. No Partnership
Your use of the Service creates no partnership, joint venture, agency, fiduciary, or other professional relationship between you and Dova AI.
